This Room Rental Agreement is made and entered into this _____ day of _______________, 20____, by and between ______________________ (hereinafter referred to as "Landlord") and ______________________ (hereinafter referred to as "Tenant"). The premises to be rented is located at ________________________________________________________________, in the State of California, specifically designated as a room labeled ______________________ (hereinafter referred to as the "Room").

WHEREAS, the Landlord desires to lease the Room to the Tenant, and the Tenant desires to lease the Room from the Landlord on the terms and conditions set forth herein.

NOW, THEREFORE, for and in consideration of the mutual promises contained herein, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows:

  1. Term. The term of this Agreement shall commence on ______________________, 20____, and shall continue until ______________________, 20____, unless earlier terminated under the provisions herein.
  2. Rent. The Tenant agrees to pay the Landlord a monthly rent of $____________, due on the first day of each month, payable at __________________________________________ or at any other address designated by the Landlord. The first month's rent is required to be paid on signing.
  3. Security Deposit. A security deposit of $____________ shall be paid by the Tenant upon the execution of this Agreement, to be held by the Landlord for the faithful performance by the Tenant of all the provisions of this Agreement. The security deposit shall be returned to the Tenant within 21 days after the Room has been vacated, less any amount applied to unpaid rent, damages, and cleaning fees, in accordance with California Civil Code Section 1950.5.
  4. Use of Premises. The Room is to be used exclusively as a personal residence by the Tenant(s) named in this Agreement and no other person may reside there without the prior written consent of the Landlord.
  5. Maintenance and Repairs. The Tenant agrees to keep the Room clean and sanitary and to promptly report any damage, defects, or malfunctions to the Landlord. The Tenant shall be responsible for any damage caused by his or her negligence or that of his or her guests or invitees.
  6. Rules and Regulations. The Tenant agrees to comply with all rules and regulations established by the Landlord regarding the use and care of the property and common areas. Such rules are attached hereto as Exhibit A and incorporated herein by this reference.
  7. Termination. This Agreement may be terminated by either party giving 30 days written notice to the other. Termination is subject to the conditions outlined in the “Early Termination” section of this Agreement.
  8. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of California.
