This California Prenuptial Agreement (the "Agreement") is made and entered into by and between _______________ (the "First Party") and _______________ (the "Second Party") on this __________ day of _______________, 20____.

WHEREAS, the Parties intend to marry and wish to define their rights and obligations regarding their individual and joint property; and

WHEREAS, the Parties wish to establish their rights and responsibilities concerning financial matters, property distribution, and spousal support in the event of separation, divorce, or death, in accordance with the California Family Code;

NOW, THEREFORE, in consideration of the mutual covenants contained herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:

1. Disclosure of Assets and Liabilities

Each Party has fully disclosed to the other Party their respective assets and liabilities, attached hereto as Exhibit A and Exhibit B, respectively.

2. Separate Property

Each Party's separate property, including assets and debts listed in Exhibits A and B, shall remain the sole and separate property of the respective Party, free from any claim of the other.

3. Marital Property

All property acquired by either Party during the marriage ("Marital Property") will be deemed community property and will be subject to division as set forth in this Agreement or as mutually agreed upon by the Parties at the time of separation or divorce, in accordance with the California Family Code.

4. Spousal Support

Both Parties have the right to request spousal support in the event of a separation or divorce. However, the terms for such support, including duration and amount, shall be determined as outlined in this Agreement or as agreed upon at the time of separation or divorce.

5. Amendments

This Agreement may only be amended or modified through a written document signed by both Parties.

6. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law provisions.

7. Complete Agreement

This Agreement constitutes the entire agreement between the Parties concerning the subject matter hereof and supersedes all previous agreements, understandings, negotiations, and discussions, whether written or oral.
