Here, we outline the process for submitting a DMCA notice should you believe your work has been copied in a way that constitutes copyright infringement on our platform.

Submitting a DMCA Notice

To file a DMCA notice, please provide a written notification containing the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, along with sufficient information to allow us to locate the material.
  • Your contact information, including your address, telephone number, and an email address.
  • A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Response to DMCA Notices

Upon receipt of a valid DMCA notice, California Templates will promptly take appropriate action, which includes removing or disabling access to the allegedly infringing content. We will also make a good faith attempt to contact the party who posted the content, informing them of the situation.

Counter-Notice Procedure

If you believe your content was wrongly removed due to a mistake or misidentification, you may file a counter-notice. This counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which California Templates may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

Last Step

Following the receipt of a counter-notice, California Templates will notify the original complaining party, inform them that we will replace the removed material or cease disabling access to it within 10 business days. Unless our Designated Agent first receives notice from the original complaining party that they have filed an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receiving the counter-notice, at California Templates' discretion.
